The Seller warrants the equipment manufactured by it to be free From defects in material and workmanship under normal use and service. The Seller's liability under this warranty shall be limited to the repair or replacement of defective parts only. Defective parts must be returned to seller (transportation prepaid) within twelve (12) months after delivery of such equipment to the original purchaser. Credit replacement or repair cannot be made for any parts claimed to be defective which shall not have been inspected buy the Seller. This warranty shall be rendered null and void if the equipment shall have been repaired altered outside the Seller's factory by anyone other than the Seller's authorized representative or if the equipment shall have been subject to misuse, neglect, accident or operation other than that for which it was designed or recommended. Tires, tubes, and similar components of independent manufacture carry the warranty of their respective manufacturers and are not covered by this warranty.
THE FORGOING OBLIGATIONS ARE IN LIEU OF ALL OTHER OBLIGATIONS AND LIABILITIES INCLUDING ALL WARRANTIES OF FITNESS OR OF MERCHANTABILITY OR OTHERWISE, EXPRESS OR IMPLIED IN FACT OR BY LAW, and state Seller's entire and exclusive liability and Buyers exclusive remedy for claim, unless otherwise specifically agreed upon, in connection with the sale
of the equipment, its design, suitability for use, installation or operations. No employee or agent of Seller is authorized to make any warranty other than that which is specifically set forth herein. The provisions in any
specification or other data provided buy Seller or attached to any Purchase Order or Sales
Order are descriptive only and are not warranties
LIMITATION OF WARRANTY- Seller will in no event be liable for any indirect, special or consequential damages whatsoever, whether grounded in tort (including negligence and patent infringement), strict liability or contract, and Seller's liability under no circumstances will exceed the contract price for the equipment for which liabilities claimed. Any action for breach of contract must be commenced within one (1) year after the cause of action has accrued.
